要旨：The relationship between family and state has long been a central concern in both premodern Japan and China. During their transformations in the late nineteenth and early twentieth centuries, however, the two countries adopted divergent approaches to modernizing their traditional family systems and family laws. Japan preserved and strengthened its traditional family law regime, whereas China, under both the Nationalist and Communist parties, sought to dismantle it. This divergence reached its culmination during the periods of Japanese militarism and fascism and the Chinese Communist Revolution. Why did the two countries choose such contrasting paths? By introducing the concept of the “bureaucratization of kin,” this research seeks to explain the historical reasons behind these divergent choices and to demonstrate how each approach operated in practice to advance the modern state-building projects of the two countries.
略歴：XIAO Weilin received his LL.B. and first LL.M. degrees from Peking University, and his second LL.M. and J.S.D. degrees from Yale Law School. His research interests include family law, comparative law, and legal history, with a particular focus on East Asia. He is the winner of the American Society of Comparative Law’s Hessel Yntema Prize in 2025 and the Colin B. Picker Graduate Prize in 2021.
