東文研セミナー「帝国・国際秩序間の主権の交渉:19世紀オスマン帝国の混合商事裁判所」が開催されました

2026年6月26日に、東文研訪問研究員のズラル・ムスル氏(ティルブルフ大学、オランダ)を迎えて、東文研セミナー「帝国・国際秩序間の主権の交渉:19世紀オスマン帝国の混合商事裁判所」が開催された。本セミナーでズラル氏は、カピチュレーションに基づく治外法権を受け入れる形で設置された混合商事裁判所について、19世紀末のオスマン帝国はそれを通常の裁判制度に組み入れて「正常化」することを試みていたと論じた。
会場からは、エジプトと比べてオスマン帝国の混合商事裁判所は成功例だったと言えるのか、それが果たして「混合」と言えるのかどうか、その管轄権の範囲は、など興味深い質問が多く出され、活発な議論が展開された。会場には5名、オンラインからは13名の参加者があった。

題目:Negotiating Sovereignty between Empire and International Order: Ottoman Mixed Commercial Courts in the Nineteenth Century

要旨:The Ottoman mixed commercial courts were tribunals composed of Ottoman and foreign judges that adjudicated commercial disputes involving Ottoman and foreign subjects in the nineteenth- century empire. Despite their significance, they have received relatively little scholarly attention, often appearing only as a subsidiary element in histories of capitulations, European imperial influence, or as precursors to the better-known Egyptian Mixed Courts. Drawing on Ottoman, French, and British archival sources, this lecture places the mixed courts at the centre of the analysis, examining them as a key site where domestic law, international law, and expanding forms of global legal ordering intersected. Situated within the empire's plural legal landscape, these courts developed innovative jurisdictional and procedural practices through which Ottoman officials sought to reconcile legal diversity, commercial integration, and sovereignty. In doing so, they reveal the Ottoman Empire's active participation in shaping international legal institutions and invite us to rethink the relationship between legal pluralism, sovereignty, and international order in the nineteenth century.

Zülâl Muslu is an assistant professor of legal history at Tilburg Law School (The Netherlands). She has expertise in global legal history and the history of international laws, with a focus on the late Ottoman Empire. Her research explores semi-colonial and decolonial dynamics, the interplay between law and emotions, and the crisis in institutional trust.
