要旨:In this talk, I will survey the profound changes undergone by the legal professions in late-19th/early-20th century China, Japan, and the Ottoman Empire, three countries which faced strong imperialist pressures for legal reforms while maintaining their independence. I argue that these pressures necessitated a fundamental recreation of legal professional structures, which proved to be a cumbersome process in all three countries. In Japan and China, the reforms formally separated judicial and administrative powers, which had theretofore been practiced in the same institutional and organizational settings. In the Ottoman Empire, where distinctions roughly along these lines had existed for centuries, new categories were created, while the existing ones were reinvented. Ultimately, I show that, while the pre-existing systems left a strong imprint on the shape of the new professions, the political needs and objectives of legal reform in the three countries led to a common logic of bureaucratic centralization in the formation of modern legal professions.

 

発表者略歴:Egas Moniz Bandeira holds a PhD from Tohoku University and Heidelberg University (joint degree). Currently, he is a researcher at Friedrich-Alexander-Universität Erlangen-Nürnberg, Germany, and an affiliate researcher at the Max Planck Institute for Legal History and Legal Theory in Frankfurt, Germany. His main research interest is global intellectual history with a focus on its refractions in modern East Asia. He is co-editor of the volumes Planting Parliaments in Eurasia, 1850–1950: Concepts, Practices, and Mythologies (London: Routledge, 2021) and Parties as Governments in Eurasia, 1913–1991: Nationalism, Socialism, and Development (London: Routledge, 2022), and has published in the Journal of Transcultural Studies, Global Intellectual History, Journal of Eurasian Studies, among others.
