【題　名】 　裁くことと裁かないことの民族誌
【要　旨】
本セミナーでは、インドネシアの地方裁判所での人類学的フィールドワークの成果を報告する。

日本でもインドネシアでも、一般の人々にとって裁判や裁判所は縁遠い存在である。
これは人類学にとっても同様で、これまでの法に関わる人類学は多くの場合、成文法や裁判よりも、
共同体における慣習法や和解に注目してきた。

本セミナーはこの両者の架橋に向けた試みであり、裁判所で展開する様々な活動に目を向けることで、
裁くためだけの場所ではないものとしての裁判所のあり方を提示したい。

【Title】 To Judge or Not to Judge: Ethnography of a District Court in Indonesia

【Abstract】
Based on anthropological fieldwork, this presentation examines daily activities
in a district court in Indonesia.

In Indonesia as in Japan, people in general are not familiar with lawsuits
or courts. Anthropologists are no exception, and when dealing with law,
they have focused more often on customary law or decision making in small
communities than on written law or lawsuits.

This presentation is an attempt to fill the gap and to indicate that the role of
court is not just to judge and decide.

インドネシアの地方裁判所の事例から、裁判所も「人間が集まるところ」だということや、裁判も人間同士のかかわりの中で行われるのだということがわかりました。
