東文研セミナー「中国の人民調解制度の起源及び研究の現状」が開催されました

報告及び討論：
報告はふたつの部分からなっていた。第一は調解（調停）制度の歴史的淵源である。伝統中国社会における調解を公権力的色彩の調解モデルと非公権力的色彩の調解モデルとに分けて歴史的過程を分析した。第二には人民調解に対する研究の整理を行った。伝統文化の側面からの解釈、機能分析による解釈、権利に関する技術の側面からの分析という3者に分けて整理を試みた。討論においては、「調解」の定義、中華民国における調解制度に対する研究の必要性、人民調解制度の変遷の歴史区分の検討の必要性などの指摘があった。

Report: Xu Qingyong geve a lecture on the hitorical origin of people’s mediation of People’s Republic of China and on preceding studies on the people’d mediation.People’s Mediation has two lines of historical origins as mediation. One belongs to public authorititative model and the other does to non public authoritative model. AS for the preceding studies on the people’s mediation , they can be devided into three patterns, interpretation by the concepts of traditional culture,interpretation by functional analysis and interpretation by the concepts of the arts for realising rights.
Issues raised during the Question and Answe period includes:
- How to define mediation and people’s mediation;
- Neccessity to study mediation or conciliation system pf the Republican China;
- How to divide or describe the hitory of people’s mediation in the PRC.
